Conveyance Thomas Hindes to George Checkley

Summary

This is a transfer in 1859 of three adjoining properties in Hanslope village from Thomas Hindes, as trustee under the will of his father Thomas Hindes, to George Checkley. The properties referred to seem to be from the Old Blacksmiths up to 18 Gold Street (the building behind what is now (2012) the wine shop - but not the present shop which was built as an extension early in 20th Century).

The tenants of each property, some previous tenants and owners are also named.

This Indenture made the Eighteenth day of May One Thousand Eight hundred and fifty-nine, Between Thomas Hindes of Prittlewell in the County of Essex Draper of the one part and George Edward Gibbs Checkley of Hanslope in the County of Buckingham Farmer of the other part Whereas Thomas Hindes late of Hanslope aforesaid Lace Dealer being at the time of his decease seized in fee of the hereditaments and premises hereinafter described and intended to be hereby conveyed duly made and executed his last Will and Testament in writing bearing date the twenty-fourth day of February One thousand eight hundred and forty four and thereby gave and devised unto his Wife Hannah Hindes his Son the said Thomas Hindes (party hereto) and his Brother Joseph Hindes of Rollesby in the County of Norfolk Baptist Minister and their heirs All and every messuages land tenements hereditaments and real estate wheresoever situated of or to which he the said Testator or any person or persons in trust for him then was or were or thereafter might be seized or entitled for and estate of freehold and inheritance or of freehold only and whether in posession reversion remainder or expectancy or of or over which he had or might have a disposing power with their rights members and appurtenances To hold the same unto the said Hannah Hindes Thomas Hindes (party hereto) and Joseph Hindes and their heirs Upon Trust that they his said Trustees or the survivors or survivor of them or his heirs did and should absolutely sell and dispose of all his said estates and premises either alltogether or in parcels and by public Auction or private Contract and to any person or persons willing to become the purchaser or purchasers thereof for such price or prices sum or sums of money as to his said Trustees or Trustee for the time being should seem reasonable And the said testator thereby declared that the receipt or receipts in writing of the said Hannah Hindes Thomas Hindes (party hereto) and Joseph Hindes or the survivors or survivor of them or the executors or administrators of such survivor or other the Trustee or Trustees for the time being acting in the execution of the Trust of that his Will for any purchase or other monies payable to them or him respectively should effectually discharge the person or persons to whom such receipt or receipts should be given his her or their heirs executors administrators and assigns from all liabilities on account of the misapplication or nonapplication nor should any such purchaser or purchasers or other person or persons be found to see to the application of the monies in such receipt or receipt respectively mentioned and acknowledged to be received or to enquire into the propriety expediency or necessity of any such sale or sales as aforesaid And the said Testator thereby appointed the said Hannah Hindes Thomas Hindes (party hereto) and Joseph Hindes Executors of that his Will And whereas the said Testator died in the month of July One thousand eight hundred and forty four without having revoked his said will and without having in any way altered or revoked the divise of his real estate or the Trust affecting the sale and disposal thereof therein contained and hereinbefore recited And the said Will with a Condicil thereto was on or about the twelfth day of July One thousand eight hundred and forty five duly proved in the Prerogative Court of Canterbury by the said Hannah Hindes and Thomas Hindes (party hereto) alone And whereas the said Joseph Hindes departed this life on or about the twentieth day of March One thousand eight hundred and forty six and was buried at Martham in the County of Norfolk And the said Hannah Hindes on the eighth day of March last and buried at Hanslope aforesaid And whereas the said Thomas Hindes (party hereto) as such surviving Trustee of the said recited will of the said Thomas Hindes deceased as aforesaid had contracted and agreed with the said George Edward Gibbs Checkley for the absolute sale to him of the messuages cottages or tenements hereditaments and premises hereinafter described and intended to be hereby conveyed with the appurtenances for an estate of inheritance in fee simple in possesion free from all incumbrances for the price or sum of Three hundred pounds Now this Indenture Witnesseth that in pursuance of the said recited agreements and in consideration of the sum of Three hundred pounds of lawful British money to the said Thomas Hindes (party hereto) in hand paid by the said George Edward Gibbs Checkley upon the execution hereof the receipt whereof in full for the absolute purchase of the messuages cottages or tenements hereditaments and premises hereinafter described and intended to be hereby conveyed with the appurtenances and the inheritance thereof in fee simple in the possession free from incumbrances he the said Thomas Hindes (party hereto) doth hereby acknowledge and of and from the same doth hereby acquit release and discharge the said  George Edward Gibbs Checkley his heirs executors administrators and assigns and every of them for ever He the said Thomas Hindes (party hereto) Hath granted bargained sold aliened released and conveyed And by these presents Doth grant bargain sell alien release and convey unto the said Goerge Edwards Gibbs Checkley his heirs and assigns All that messuage or tenement with the shop outbuildings yards and premises thereto belonging situate standing and being in the Church End Hanslope aforesaid and now in the occupation of Samuel Harris And also all that messuage cottage or tenement adjoining the before mentioned messuage and now in the occupation of Joseph Ancell Which said premises heretofore formed one messuage or tenement and premises only and as such were formerly occupied by Abraham Philips since by William Saxby and late by the said Thomas Hindes deceased And Also all that Cottage or Tenement adjoining the said firstly described premises with the Garden Ground belonging thereto formerly in the occupation of Martha Gregory Widow afterwards of Henry Elliott since of his Widow late of Elizabeth Billing and now of John Richards All which said hereditaments and premises were many years since occupied as one messuage or tenement and premises by Richard Miles and Joseph Miles successively And the same are bounded on or towards the South East by a cottage and premise belonging to the Town of Hanslope On or towards the North east by the Common Street of Hanslope On or towards the North West by cottages and premise now the property of John Rose and on or toward the South West part thereof by the Ground and premises heretofore of Joseph Elkins and now of the said George Edward Gibbs Checkley Or howsoever otherwise the same are or have been abutted bounded tenanted or described Together with all houses outhouses edifices buildings barns yards gardens trees fences mounds ways passages privileges easements advantages hereditaments rights members and appurtenances whatsoever to the said messuages cottages or tenements hereditaments and premises intended to be hereby conveyed belonging or appertaining or therewith now or heretofore held used occupied or enjoyed And the reversion and reversions remainer and remainders rents issues and profis thereof And all the estate rights title interest use trust inheritance property possession benefit claim and demand whatsoever both at law and in equity of him the said Thomas Hindes (party hereto) in to and out of the same hereditaments and premises and every part thereof To have and To hold the said messuages cottages or tenements hereditaments and premise hereinbefore described and intended to be hereby conveyed with the appurtenaces unto the said George Edward Gibbs Checkley his heirs and assigns to the only proper and absolute use of the said George Edward Gibbs Checkley his heirs and assigns for ever And the said George Edward Gibbs Checkley hereby declares that his Widow if any shall not be entitled to dower out of or in the said hereditaments and premises or any part thereof And the said Thomas Hindes (party hereto) for himself his heirs executors and administrators doth hereby covenant promise and agree with and to the said George Edward Gibbs Checkley his heirs and assigns That he the said Thomas Hindes (party hereto) hath not made done committed executed occasioned or suffered or been party or privy to any act deed matter or thing whatsoever whereby or by reason or means whereof the said messuages cottages or tenements hereditaments and premises hereinbefore described and intended to be hereby conveyed or any part or parts thereof are is can shall or may be impeached charged incumbered or prejudicially affected in title estate of otherwise howsoever In Witness whereof the said parties to these presents have hereunto set their hand and seals the day and year first above written.
