Transcript of Lease of 1694 to Sir Peter Tyrill

This Indenture made the ffive-and twentieth day of March In the sixth yeare of the Reign of our Sovereigne Lord and Lady William and Mary by the grace of God of(?) England Scotland ffrance and Ireland King and Queen Defenders of the ffaith etc. A.D.1694   Betweene the Major Sherriffs Cittizens and Comonaltie of the Citty of Lincoln of the one part(?) And Sr Peter Tyrrill of Thorpp in the Parish of Hanslopp in the County of Buckingham Barronet of the other part,  Witnesseth That the said Major Sherriffs Cittizens and Comonaltie ffor and in Consideration of the sume of One Thowsand and five hundred pounds of lawfull money of England to them at or before the ensealing and delivery of these presents well and truly and the receipt whereof the said Major Sherriffs Cittizens and Comonaltie doe hereby acknowledge and thereof and of every part thereof doe acquitt and discharge the said Sr Peter Tyrrill his Executors and Administrators by these presents and of the Rents herein after reserved And for other good causes and consideration when thereunto moveing(?)  Have with one(?) ... ... given  ... … demised Granted and to farm letten and by these presents doe demise Grant and ... Said Parsonage ... all Messuage houses(?) buildings Orchards Gardens Tofts Crofts Gleablands Sanctuary ground Lands Orchards meadows feeding pastures tythes oblacons revercons fruits offerings waifes Strayes Escheats Leets Courts perquesits  of Court view of franck pledge amirciaments profits rights priviledges liberties Rents Revercons Services and hereditame nts and all other profits comodities and advantages whatsoever in Hansloppe aforesaid or Elsewhere in the said County of Buckingham to the said Rectory Parsonage and Mannor or any of them belonging or appertayning or with the same or any of them used occupied granted demised or purchased (The Advowson guift grant and free disposition of the Viccaridge of Hansloppe aforesaid and all Woods and underwoods in or upon the premisses letten during the term thereof and also the Vicarage house there alwayes Excepted and foreprized)  To have hold occupy and enjoy the said Rectory Parsonage and Mannor aforesaid and all other the premisses with the appurtenances (Except before excepted) unto the said Sr Peter Tyrrill his Executors and Assignes from the day of the date of these presents for and dureing and unto the full end and term of or for one and twenty yeares thence next ensewing fully to be compleate and ended   Yielding and paying therefore yearely every year during all the said term to the said Major Sherriffs Cittizens and Comonaltie and ... theire Successors and Assignes the yearely Rent or sume of one hundred(?) and threescore pounds of lawfull English money at the ffeast of St Michaell the Archangell and the Annunciation of our Lady by even and equall portions, And the further yearely Rent of Seven and fforty pounds of like lawfull money at the ffeasts of St John Baptist St Michael the ArchAngell the Nativity of our blessed Saviour and the Annunciation of our Lady by even portions at and in the said Citty to the hands of the Major of the said Citty for the time being or of his Assignee or Assignes to the use of the said Major Sherriffs Cittizens and Comonaltie and theire successors  And one fatt Buck or Twenty shillings of lawfull English money in liew thereof on every seven and twentieth day of September yearely during the said term at and in the said Citty to the hands of the Major Elect of the said Citty for the time being or of his Assignee or Assignees   And if it shall happen the said yearely rent of One hundred and Threescore pounds and seven and forty pounds or either of them or any part or parcell thereof to be behinde and unpaid at any of the said feasts at which the same ought to be paid as is aforesaid (may be word missing) by the space of thirty days after That then this present grant and demise shall cease determine and be void   And that then and at all times after it shall and may be lawfull to and for the said Major Sherriffs Cittizens and Comonalty and theire Successors or Assignes  into all the said Recory Mannor … … .(obsure) … … every part & parcell thereof wholy to Reenter and the same to have againe repossesse and enjoy as in theire former right and … Any ... Lawfully charged laid and assessed of hereafter to be charged laid and assessed upon the said Major Sherriffs Cittizens and Comonalty and theire Successors & Assignes(?) Excepted & foreprised) and off and from all the said payments and charges and all actions Suites & molestacons for or by reason of the non paymt. thereof or of any of them (Except as before excepted) shall from time to time and at all times hereafter acquitt exonerate and discharge or save harmless and imdempnified the said Major Sherriffs Cittizens and Comonalty theire Successors & Assignes and theire Lands and goods  And that he the said Sr Peter Tyrrill his Executors or Assignes shall at all & every time and times dureing all the said term when and as often as need shall require at his or theire own costs and charges well and sufficiently repaire maintaine amend & uphold in all manner of needfull reparacons aswell all the houses & buildings chancells walls hedges and fences standing or being on the day of the date hereof in or upon the premisses by these presents demised or any part or parcell thereof which shall not be taken downe according to the power hereinafter granted as also all houses buildings walls hedges and fences which at any time hereafter during the said term shall by or with the agreement or consent of the said Major Sherriffs Cittizens & Comonalty theire Successors or Assignes be thereupon built made or set up, and the same so well & sufficiently repaired at the end of the said term shall leave and yield up,   And the said Sr Peter Tyrrill or some other Gentleman or substantiall yeoman of honest and reasonable calling shall be most comonly resident & dwelling upon the said parsonage or keep an honest undertenant to be dwelling and resident thereupon during the said term for to keep house there during the same   And that neither he the said Sr Peter Tyrrill his Executors Assign or Assignes nor any other person or persons permitted and accepted by this clause hereafter to be assigned or granted of the premisses or any part thereof now any other person or persons whatsoever haveing interest hereafter therein by Licence or otherwise shall at any time hereafter alien lett sett grant or assigne over by any wayes or meanes this present indenture or lease nor his or theire right title possession interest or term of yeares aforesaid or any part or parcell thereof to any person or persons whatsoever for the whole term aforesaid other than to wife childe or children or Brethren or Brethrens children of the said Sr Peter Tyrrill or to some of them or to the heirs ... ... of the said Sr Peter Tyrrill... ... .. herein contained on his and theire parts to be performed shall and may during all the said term have hold occupy possesse and enjoy the said Parsonage Mannor and all other the premises with the apptenances and every parcell thereof (Except before excepted) and the issues profits and revenues thereof ariseing or comeing shall quietly and peaceably receive and take without any lawfull lett interruption or impediment of the said Major Sherriffs Citizens and Comonaltie or theire Successors or any other lawfully haveing or clayming any right title or interest by from or under them or any of them according to the true meaning of these pressents And Whereas Sr Thomas Tyrrill late ffather of the said Sr Peter Tyrrill did in his life time erect and build one house upon the said premisses which never was finished or made fitt for habitation   Now the said Major Sherriffs Cittizens and Comonaltie for them and theire successors doe grant and agree with the said Sr Peter Tyrrill his Executors Assignes by these presents That it shall and may be lawfull to and for the said Sr Peter Tyrrill his Executors and Assignes or any of them at any time or times during the said term to take or cause to be taken downe the said house so built upon the said premisses by the said Sr Thomas Tyrrill decd. As aforesaid and the materrialls thereof to sell or otherwise to convert to his or theire own use or thereof to dispose as to him or them shall seem meet And in Consideration thereof the said Sr Peter Tyrrill for him his heires and Assignes doth Covenant and grant to and with the said Major Sheriffs Citizens and Comonalty and theire Successors and Assignes by these presents  That he the said Sr Peter Tyrrill his Executors or Assignes at his or theire own proper costs and charges shall and will before the end or expiration of three yeares to be accompted from the date of these presents Erect build and finish or cause to be errected built and finished upon some convenient place upon the said premisses a new good and strong dwelling house and Barns Stables and outhouses neare unto the same fitting and convenient for a Tenant of the said .... ... ... And Whereas the said Major Sherriffs Cittizens and Comonaltie of theire own free and voluntary .... and int... that the said seven and fforty pounds so yearely reserved to them and theire Successors to be paid at the said four quarterly payments as aforesaid shall be yearely during the said term paid to ... ... ... aforesaid for the time being to & for his own proper use  They the said Major Sherriffs Cittizens and Comonalty for them and theire Successors doe Covenant and grant to and  with the said Sr Peter Tyrrill ... .... ... ... ... by these presents That mean(?) the said Sr Peter Tyrrill his Executors Assignes shall yearely during all the said term pay or cause to be paid to the Viccar of Hanslopp aforesaid for the time being for his own proper use the yearely sume of seven and fforty pounds of lawfull English money at the said ffests of St John Paptist St Michael the Archangell the Nativity of our blessed Saviour and the Annumciation of our Lady by even porcons Then they the said Major Sherriffs Cittizens and Comonalty theire Successors or Assignes shall not and will not distraine or any wayes sue for the said Rent of Seven and fforty pounds reserved to them as aforesaid or for any part thereof or take any advantage of the Condition herein before contained for the makeing of the present grant and demise to be voids for the non payment of the same or any part thereof But thereof and of every part thereof from time to time and at all times as the same shall be duely paid as aforesaid to the Viccar of Hanslopp aforesaid for the time being shall upon reasonable request acquitt and discharge the said Sr Peter Tyrrill his Execotors and Assignes by these presents   In Witness whereof to the one part of these presents remaineing with the said Sr Peter Tyrrill the said Major Sherriffs Cittizens and Comonaltie have set theire comon Seale and to the other part thereof remaineing with the said Major Sherriffs Cittizens and Comonaltie the said Sr Peter Tyrrill hath set his hand and Seale the day and yeare first above written.  ===1694 ===
